Two men have filed a lawsuit in the Philadelphia Court of Common Pleas. In their civil complaint, the men allege that DraftKings and other companies that facilitate sports betting have engaged in tactics that led them to develop gambling addictions and lose tens of thousands of dollars. Allegations in the lawsuit against DraftKings include design defect, negligence, failure-to-warn, emotional distress, and unjust enrichment. The lawsuit says that micro-betting and AI have created an environment that pushes otherwise healthy gamblers to become addicted to the app. The lawsuit also lists FanDuel and the National Football League as defendants. The NFL owned Genius Sports from 2021 to 2025. Genius Sports (GENI), “powers more than 98% of the sports betting market with officially-licensed NFL data.”

February 26, 2026: Judge Denies DraftKings’ Request to Dismiss Lawsuits, Orders DraftKings to File Answer

A group of consumers sued DraftKings, alleging that the company engaged in misconduct that included unfair and deceptive promotion terms. Before filing a response to the amended legal complaint, DraftKings filed a motion to dismiss. The company attempted to argue that it should not be held liable under state product liability laws because its platform is a service and not a product. The lower court rejected DraftKings’ argument, and DraftKings asked permission to file an appeal, which was also denied. The court’s order requires DraftKings to file a response to the consumers’ first amended complaint by March 18, 2026.

December 30, 2025: Man Petitions Courts for Class Action Against DraftKings for Alleged Violations of Gambling Laws

A man in Michigan has filed a class action complaint against DraftKings and its subsidiaries. In his complaint, he accuses DraftKings of violating Michigan gambling laws, particularly regarding in-app gaming protections for bettors. Specifically, the lawsuit alleges that DraftKings does not include state-mandated patron-protection features, such as required 24-hour waiting periods for limit increases. The class (people who could be named as plaintiffs in the lawsuit) contains more than 100 members, and the amount of alleged damages is more than $5 million.

July 10, 2025: DraftKings Enters $3 Million Settlement with Connecticut DCP Gaming Division Over Misleading Advertisements and Promotions

DraftKings and its subsidiaries have entered into a settlement with the Connecticut DCP Gaming Division, resolving legal claims that the company misled consumers. Connecticut authorities had launched an investigation over allegations that DraftKings made false and misleading promises to customers in its bonus offer promotions and advertisements. The promises made in the advertisements were accused of violating Connecticut’s state laws and regulations. DraftKings denied wrongdoing. However, it agreed to refund 7,000 consumers a combined total of over $3 million to reimburse them for the money they lost in allegedly improper promotions.

June 1, 2025: CA Consumers Sue DraftKings, Claim Company Misled Them Into Participating in Illegal Contests

A group of consumers in California has filed a legal claim against DraftKings, accusing the company of misleading them into participating in illegal daily fantasy sports (DSF) contests. Gambling and games of chance are illegal in California, and a formal opinion filed by the California Attorney General has said that some types of daily fantasy sports are games of chance. According to the legal complaint, DraftKings allegedly led some California consumers to believe that certain DraftKings contests were legal games of skill rather than illegal gambling contests. Some of these consumers are suing DraftKings, saying it should have been transparent about whether the contests were legal in California.

May 28, 2025: DraftKings Sued After Cancelling Iowa User’s Multimillion Dollar Payout

DraftKings is being sued by an Iowa consumer after the company voided the consumer’s $14.2 million winnings in a golf tournament bet. The man placed high bets during a golf tournament that was cut short because of the weather. During the continuously delayed tournament, the man placed a series of bets on the tournament’s top-performing golfers. All the man’s bets hit and were winning bets. However, DraftKings voided those wins because it said “errors” had occurred that invalidated the wins under its “house rules.” The man argues that the “house rules” were improperly applied and changed after the fact so that DraftKings did not have to pay the man his winnings.

April 3, 2025: City of Baltimore Sues DraftKings Over Violations of Baltimore’s Consumer Protection Laws

The City of Baltimore has filed a lawsuit against DraftKings, accusing the company of misleading and exploiting its users by using deceptive tactics and an addictive in-app design. In support, Baltimore’s legal counsel describes how DraftKings’ bonus bet promotions require users to spend $150 in real-world dollars in exchange for six in-game bonus bets, which are each worth $25 and need to be used within seven days after the user creates a DraftKings account. The lawsuit also alleges that DraftKings targets users by using their usage data to identify and influence the users who tend to bet (and lose) the most. The suit also accuses DraftKings of ignoring users’ requests to be taken off the platform because of concerns over gambling addictions.

April 18, 2025: Pennsylvania Class Action Claim Filed Against DraftKings Over Deceptive, Predatory, and Unlawful Conduct

Five people have filed a class action legal complaint in Pennsylvania, seeking compensation for losses stemming from DraftKings’ allegedly improper gambling operations. The complaint accuses DraftKings of targeting problem gamblers and fostering disordered gambling. The legal document cites reports that the company uses detailed user data to personalize its advertising and push-notification tactics for individual users. The people filing the lawsuit also claim that DraftKings ignored user-submitted requests to remove them from the site because of concerns over their gambling habits.

July 11, 2024: Indiana Class Action Lawsuit Filed After DraftKings Voids His Winning Bets for the LA Lakers versus the Denver Nuggets Game

A man is suing DraftKings for refusing to pay him $150,000 in winnings from bets placed on DraftKings during a Lakers v. Nuggets basketball game. The so-called “seven-leg bets” were placed during an October 24, 2023, game and were voided by DraftKings the day after all bets hit and were winning bets. DraftKings said the bets were voided due to an “error” and canceled them. However, the man filing the lawsuit said DraftKings knew about the “error” when it accepted the bets, and the company continued to accept bets during the entirety of the game. The man says that it is unfair and deceptive for DraftKings to void the bets after receiving.

What Is the DraftKings Gambling Lawsuit?

DraftKings gambling lawsuits accuse DraftKings of failing to follow state gambling laws, misleading customers about contests on its platform, and other misconduct. Some consumers believe the way DraftKings is designed and operates encourages compulsive gambling behaviors.

More than 30 states have made some forms of gambling legal, but many have restrictions in place to help curb problem gambling and protect consumers. Online sportsbook apps like DraftKings have become increasingly popular. In 2024, digital sports-betting platforms brought in $13.7 billion in commercial gambling revenue.

Unlike traditional brick-and-mortar gambling, online sportsbook apps like DraftKings can provide users with potentially unlimited and easy access to sports betting opportunities. For example, consumers can continually participate in contests, place bets about live or upcoming sporting events, and use bonus bets and credits to buy into more betting opportunities. Research suggests that this increase in opportunities for sports   betting is associated with a rise in people seeking help due to problem gambling.

For example, a 2025 study found that online, in-home betting platforms (like DraftKings) are more likely to lead to gambling addictions than traditional, in-person gambling. Having 24/7 access to DraftKings or another betting platform can allow the person to incorporate gambling into their personal, professional, and home routines. If a person makes DraftKings part of their daily routine, it can further entrench the addiction and make it difficult for the person to cut back or stop gambling on DraftKings.

How Does the DraftKings Platform Allegedly Promote Gambling Addiction?

Many users believe the way DraftKings is designed encourages problem gambling and addiction. Some of the possibly addictive features in DraftKings include:

For example, research has found that electronic gaming machines have many features that may make them more attractive and potentially addictive to users. These features include rapid decisions, a high-stimulation environment, quick payouts and results, disguising losses as wins, and using credits instead of dollars as the in-game currency. DraftKings shares many of these characteristics, including using in-game credits and bonus bets as rewards, ample micro-betting opportunities, and a high-stimulation mobile gaming environment.

One study also found that people who gamble on electronic gaming machines (EGMs) have a harder time telling ”how . In that study, the researchers found that people who gambled on EGMs may be more likely to re-gamble their winnings rather than cash out. They suggested that this pattern among EGM consumers may drive addictive tendencies.

Since DraftKings uses many features of EGMs, people who use it may also struggle to gauge how much they have won or lost and their likelihood of a big win in the future if they stay in.

Lawsuits Say DraftKings Deceptive Gambling Ads and Promotions

DraftKings is accused of using deceptive and misleading advertising tactics and promotions to attract and keep sports betting customers. For example, one complaint alleges that DraftKings uses deceptively titled “risk-free,” “no-sweat,” and “deposit-matched” promotions and bonus bets.

The person filing the lawsuit believes these labels are misleading because they make the consumer feel the bet is likely to yield wins or minimal losses. In actuality, the complaint alleges that some of these involve hard-to-attain cash prizes, costly buy-ins for consumers, and bonus bet payouts that cannot be exchanged for actual money. The complaint also accused DraftKings of using user data to advertise in ways that target and foster connections with consumers with high losses and frequent bets.

Another class action complaint filed in New Jersey accuses DraftKings of similar misconduct, such as using deceptive and misleading “risk-free bets” and “no sweat first bets” to encourage vulnerable consumers to gamble more than they want to. Under these schemes, the complaint explains, users are required to pay cash up front, under the impression that, if they lose the bet, they will at least get something of an equal value. However, many people who lose their bets receive “expiring bonus bets” instead, which can only be used to place more bets.

Some of these additional bets require cash payments from the consumer, or the consumer is given a chance to put in more cash to boost their bets. However, for many, these bonus betting opportunities led to winning additional bonus bets, requiring consumers to use the credits again before they expire, often with the same result. According to the complaint, the class action plaintiffs may not have bought into these risk-free bets if they had known that these terms existed.
