FanDuel is facing a class action lawsuit filed by a California man who claims the platform allowed him to participate in a FanDuel-run contest that may be illegal in California. California law bans most forms of gambling and wagering, but certain contests are permitted. The man says FanDuel provided confusing and misleading information about whether a contest was legal in California.

In the legal complaint, the man’s attorney presents screenshots from FanDuel’s website showing a U.S. map that suggests the contest is legal in California. However, the man’s attorney alleges that this information is inaccurate, and the man participated in an illegal contest that he would not have participated in had he known it was prohibited in California.

July 3, 2025: California Attorney General Says FanDuel Daily Fantasy Sports Contests Are Illegal Gambling Under CA Law

California’s Attorney General Rob Bonta issued a legal opinion indicating that draft fantasy sports contests constitute illegal gambling under California state law. FanDuel and other sports betting apps offer daily fantasy sports (DFS) contests like draft-style games and “pick ‘ems.” According to the California AG, both styles of sports betting are illegal under California’s criminal laws. That means people who use FanDuel while in California may be prohibited from placing those types of bets on the platform.

However, separate lawsuits allege that FanDuel has not been transparent with users about what forms of gambling are and are not legal while users are in California. People who think FanDuel misled them into placing illegal daily fantasy sports bets on the platform may qualify for compensation.

July 2, 2025: California Class Action Lawsuit Accuses FanDuel of Misleading Consumers About Contests

However, some games of skill are allowed. According to a class action complaint, FanDuel was misleading about which of its daily fantasy sports contests were illegal in California. Some of those consumers want to hold FanDuel accountable for its alleged lack of transparency.

June 16, 2024: New Jersey Officials Fine FanDuel for Accepting Users’ Bets on Fights That Were Already Over

New Jersey’s Division of Gambling Enforcement fined FanDuel $2,000 and ordered it to reimburse people for over $200,000 worth of bets placed on a mixed martial arts fight that had already taken place. FanDuel advertised the MMA fights as live events that had not yet occurred. However, the MMA fights being wagered on were replays of a prerecorded fight that occurred a week earlier. According to New Jersey authorities, FanDuel did not talk to the Professional Fighters League about whether the MMA matches were live or pre-recorded before accepting bets on them.

March 12, 2024: Former Jaguars Employee, Amit Patel, Sues FanDuel for Allegedly Exploiting His Gambling Addiction and Position

Amit Patel has filed a lawsuit against FanDuel, claiming the company used predatory and negligent advertising tactics to exploit his gambling addiction. Amit worked for the Jacksonville Jaguars. Over 5 years, he gambled over $20 million in funds he allegedly stole from the Jaguars. According to his lawsuit, FanDuel promoted Amit to a VIP status, and he was assigned a VIP host who worked with him directly and fostered his interest in placing more bets.

Amit and his VIP host would message each other up to 100 times per day. Amit’s legal team believes that FanDuel took advantage of Amit’s gambling addiction and his lucrative position with the Jaguars to make as much money as they could from Amit. Amit is serving a multiyear prison sentence for stealing money from the Jaguars. However, his attorneys believe that FanDuel should share in the blame for what occurred.

March 24, 2022: New Jerseyan Sues FanDuel for Not Letting Him Withdraw Money Unless They Gambled With It First

FanDuel is being sued by a man in New Jersey who says he was not allowed to withdraw money from his account because he had not gambled with it yet. FanDuel’s terms and conditions said that users could withdraw their funds and cancel their accounts if they were not suspected of fraud or other illegal activity on the app. However, FanDuel prevented the man from transferring his un-gambled funds back to his bank account. The man filed his lawsuit as a class action on behalf of other FanDuel users who encountered the same issue.
