Under both the federal Controlled Substances Act and New York Penal Law (Chapter 40, Part 3, Title K, Article 178), it is illegal to possess, sell, or distribute any prescription medication that has not been explicitly approved by a licensed physician, as these are considered “controlled substances.” This can apply to nearly any prescription drug, although certain drugs are treated with particular concern due to their potential for misuse and serious addiction, such as painkillers and/or opiates.
