The arrests occurred following a report of a burglary, which involved the theft of cigarettes in an amount exceeding $3,000. The Livingston County Sherriff’s Office arrested Eric Smith of Rochester, Kristina Marble of Scottsville, and Andrew Duckworth of Batavia. They were each charged with offenses on November 9, 2021, and two of them had been involved in the 2020 investigation into nearly two-dozen burglaries.
The recent arrests happened when a business in the Town of Conesus reported a commercial burglary on October 26 when an employee showed up at work to find the front of the business “shattered.” Deputies from the Livingston County Sheriff’s Office responded and determined that “more than $3,000 in merchandise had been stolen from the store.” The “nature of the crime,” according to the article, suggested to investigators that there was a connection between the burglaries that had been under investigation in 2020, which occurred across county lines. Accordingly, the Livingston County Sheriff’s Office got in touch with other counties where these burglaries had occurred and determined that those offenses included the “same modus operandi” as the retail theft in the Town of Conesus.
Charges Related to Alleged Theft Offenses
Both Smith and Marble had previous felony convictions on their records and were charged with multiple felony offenses including Burglary in the Third Degree, Grand Larceny in the Third Degree, and Criminal Mischief in the Third Degree. Duckworth, the third-party allegedly involved in the recent Livingston County burglary, was charged with two counts of Burglary in the Third Degree as well as two counts of Petit Larceny. In addition, the article suggests that other agencies involved in the 2020 burglary investigations are likely to seek additional charges for what law enforcement officials have described as “smash and grabs.”
