Holding Peloton Accountable for Child Injuries

Child injuries can occur in a variety of ways, from involvement in motor vehicle collisions to the use of defective products in the home. Given that children are still growing and developing, personal injuries can be particularly devastating, often resulting in life-long disabilities when a child does survive a serious injury. In most cases, these injuries are preventable, yet they continue to occur as a result of negligence and other forms of liability. According to The Washington Post, Peloton—the now-prominent exercise machine company—faces serious concerns from the U.S. Consumer Product Safety Commission (CPSC) about its treadmills. Indeed, the CPSC has told consumers who have small children that they should not purchase and use these machines due to the risk of injury they pose to children.

It is critical to hold the responsible party accountable for a debilitating child injury, and Peloton could become the subject of numerous lawsuits in New York and across the country. One of our experienced Rochester child injury attorneys can provide you with more information about filing a personal injury lawsuit against the exercise product maker.

Child Injuries and the Peloton Treadmill

Home workout machines made by the popular company Peloton might pose unreasonable risks to children. According to the CPSC, Peloton’s Tread+ product—a type of home treadmill—has been linked to one serious child injury and one child death. The CPSC reported that the child who was injured by the machine became “trapped under a Peloton Tread Plus, found by his father to be not breathing and pulseless.” The child suffered a serious brain injury, and “was found to have tread marks on his back matching the slats of the treadmill . . . and petechiae on his face, presumably from occlusion of blood flow.”

Every year, treadmills cause serious injuries, and approximately 2,000 kids under the age of eight suffer these injuries annually.

How Can a Personal Injury Attorney Help with a Child Injury Claim?

At King Law, we know how devastating it can be for your child to suffer an injury that could have been avoided. When it comes to seeking financial compensation for your child’s current and future medical bills, and holding the at-fault party accountable, our firm can help in a variety of ways. We can determine your immediate eligibility for seeking compensation through an insurance claim. When an insurance claim cannot provide you with the compensation you need, or when an insurance claim is not an option, we can discuss your eligibility for filing a personal injury lawsuit against the liable party or parties. After filing a lawsuit, we can work to get you compensation as quickly as possible by negotiating with the defendant for a fair settlement offer.

Our goal is to help parents and caregivers obtain a reasonable settlement or verdict that can help to cover the costs of medical treatment over time. In some cases where the harm is particularly egregious, we may be able to help you seek punitive damages that are designed to punish the individual or company for causing severe and life-threatening child injuries.
